By accessing and using Nurture Skin’s website (www.nurtureskin.co.za) you are acknowledging you have read, understood and agree to be bound by these Terms and Conditions. These Terms and Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Any new features which are added to the current website shall also be subject to the Terms and Conditions. You can review the most current version of the Terms and Conditions at any time on this page. We reserve the right to update, change or replace any part of these Terms of Conditions by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of, or access to, the website following the posting of any changes constitutes acceptance of those changes.

You may not access, display, use, download, or otherwise copy or distribute content obtained on this website for marketing and other purposes without our consent.

PURCHASE

Once you have completed your order you will receive an email with your order details, including an order number. If we are unable to fulfil this order, due to out-of-stock items, identified product or pricing error, or unable to obtain authorisation of your payment, we will contact you to inform you. If you require any information concerning your order, please email us at info@nurtureskin.co.za – please use your order number in the subject line.

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue a product without notice. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the service.

An agreement of sale comes into effect when either a credit card authorisation is received from the issuing bank, or a bank transfer is reflected on our bank statement. Please note that we reserve the right to reject any offer to purchase by you at any time.

You can purchase a product by using any method, as per our PayFast provider: credit cards, cheque cards, Instant EFT (via Internet Banking), Bitcoin, mobicred, Masterpass, SCode and debit cards.

If the issuer of your payment card refuses to pay, or does not for any reason authorise us, we will not be liable for any delay or non-delivery of products. Please note that we retain the legal ownership of all products until full payment has been made by you and received by us. Legal ownership of the products will immediately transfer back to us if we refund any payment for the products to you.

DELIVERY

Delivery is made to the physical address given to us on our website (www.nurtureskin.co.za). Should no one be available to receive the parcel when delivered, the courier service will contact you to agree on a date for delivery. You accept that in order for us to prove delivery of an order, or part of an order, we do not have to prove you personally received the goods, but that any person at the delivery address specified on your order signed for the delivery. Postal deliveries are not approved. You can collect your product at an agreed location.

RETURNS

You may exchange our product in their new, unopened and unused condition within seven working days of delivery for a different item, voucher or full refund, if you send us a notice of cancellation (email info@nurtureskin.co.za) in writing.. This policy is for goods purchased on this website (www.nurtureskin.co.za).

On receipt of the returned goods, we will give you a refund of the amount paid for the products. Refunds will be made against the original form of tender. Please note that the return delivery costs will not be reimbursed.

We do our best to ensure the product information, availability, purchase price and associated delivery times and fees are accurately reflected on our site. However, should we accidentally deliver the wrong product to you, or if the product is not as described on the website, or is missing any parts:

  • Please do not remove the product from its original packaging or any of the stickers or labels.
  • Notify us as immediately and we will collect the product from you.

We will do either of the following, according to your choice:

  • Deliver the correct item to you as soon as possible (if available); or
  • Send you a voucher for the purchase price of the product.

Please note, we have made every effort to display the correct images and colours of the products that you shall order. We cannot guarantee your phone or computer’s display of colour is accurate.

COMMENTS

Should you at our request, or without our request, send ideas or suggestions through a proposal or other material, via online, email, postal mail, or other, you agree that we may, at any time, edit, copy, publish, distribute and otherwise use any form of material and any comments that you forward to us. We are and shall be under no obligation to maintain any comments in confidence; pay compensation for any comments; or to respond to any comments.

You agree any comments will not be unlawful, abusive or obscene or contain computer virus or malware. The information you provide is to represent yourself and should not misleading. We take no responsibility and assume no liability for any comments posted by you or any third-party.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless Nurture Skin (Pty) Ltd and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms and Conditions, or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

LAW

These Terms and Conditions, where by we provide you a service and product, shall be governed by and in accordance with the laws of Nurture Skin (Pty) Ltd, based in South Africa.
